The promise allegedly was made orally, but Visionaire claims that the solicitation created an implied promise for payment and credit to the company. Among the people contacted by Visionaire were the five families who later appeared on the show, according to the company. Then, in April, Visionaire says it got a surprise. Higa abruptly gave notice that she was leaving the company.Visionaire now says that after Higa departed, she surreptitiously continued to work on the project with Discovery/TLC and breached confidence by communicating "proprietary information about cast members and their roles, film shooting locations, plot elements, major events, and themes." Visionaire is now taking Discovery and Higa to court on claims of breach of contract, interference with contract, and breach of confidence. Visionaire is pursuing a legal avenue that is quickly becoming a headache for Hollywood studios as well as a favorite among plaintiff's lawyers pursuing "stolen" ideas. (See here.) As I cautioned when the Independent Filmmaker Project announced this year's nominees, there is little reason to believe that the results at the Gothams have any direct impact on the Oscar race -- sometimes both organizations happen to arrive at the same choice (see: The Hurt Locker), but the reality is that Gotham nods and wins are really a reflection of nothing more than the tastes of the five-person "committees" that are arbitrarily selected and assigned to the various categories by the IFP (some members of which have never worked on a film), whereas Oscar nods and wins are determined by thousands of people (virtually all of whom are filmmakers). Moreover, they got a cherry on their cake, as Gary Oldman, who is on the bubble in the best actor race for his understated performance in Tinker Tailor Soldier Spy, was the subject of a glowing tribute from Alec Baldwin, a great montage of his life's work and the night's only standing ovation afforded to an individual. STORY: 'Tree of Life,' 'Beginners' Tie for Best Feature at Gotham Awards Paramount is pretty happy right now, as well. They have been campaigning aggressively on behalf of Charlize Theron (Young Adult) and Felicity Jones (Like Crazy), both of whom they'd like to sneak into the competitive best actress race, and their efforts got a big boost last night thanks to Theron's tribute (during which she and her co-star/best supporting actor hopeful Patton Oswalt stole the show) and Jones' somewhat surprising win over two other young women who have been seen as likelier bets for Oscar nods, including one of whom is competing in the same category: Elizabeth Olsen (Martha Marcy May Marlene). Fox Searchlight likely has mixed emotions. The Descendants and Martha Marcy May Marlene, which led the entire field with three nods each -- including the big two, best feature and best ensemble -- both went home empty-handed. However, their night was somewhat salvaged when The Tree of Life, their tough-sell best picture Oscar hopeful, won best feature (it tied with Beginners). Complete List of Gotham Awards Winners Roadside Attractions has to feel a little disappointed with the way things turned out for their films. IFP first denied Albert Nobbs any nominations, and then denied Margin Call -- a red-hot film at the moment -- a win in the one category in which it was nominated and really fit the bill: best ensemble. As great a film as the category's winner Beginners is, it's primarily a four-person flick (Ewan McGregor, Melanie Laurent, Christopher Plummerand Goran Visnjic), whereas its hard to even keep count of all of the impressive moving pieces in Margin Call (Zachary Quinto, Jeremy Irons, Kevin Spacey, Stanley Tucci, Paul Bettany, Demi Moore, Simon Baker, Penn Badgley, Mary McDonnelland the list goes on). Sony Pictures Classics can't be thrilled about its showing. While David Cronenberg, who directed its film A Dangerous Method, was the subject of a nice tribute, Take Shelter, its stronger Oscar contender -- which is thought to be on-the-bubble for best actor (Michael Shannon) and best original screenplay (Jeff Nichols) -- was shut out after scoring nods in the top two categories, best feature and best ensemble. STORY: The Scene Inside the 2011 Gotham Awards Oscilloscope is a small and young enough studio that it was probably happy just to have a ticket to the party. The fact that Meek's Cutoff came up short for best feature and Evan Glodell (Bellflower) didn't win best breakthrough director can't have knocked anyone's socks off. The Weinstein Co. had its Gotham hopes dashed long before Monday night -- oddly enough, its films weren't rewarded with so much as a single nomination! Disney sets ESPN topper transition
Disney revealed a glimpse at ESPN's future today: company topper Robert Iger has announced a succession plan for the net, moving George Bodenheimer to exec chairman of the sports network, moving from prexy of ESPN and ABC Sports and co-chair of Disney Media Networks and giving up his day-to-day duties at the net. The changes will take effect Jan. 1, 2012.Taking over daily operations will be John Skipper, who moves into the position vacated by Bodenheimer. Skipper has been ESPN's exec veep of content since Oct. 2005. Skipper will have a dual report to Bodenheimer and Iger; Bodenheimer will report to Iger alone.Iger himself is part of a recently-announced succession plan; Disney has set March 2015 as the date the exec will step down from his CEO duties and become chairman. Endemol Creditors Reject Time Warner Takeover Bid
Creditors of European reality TV powerhouse Endemol have decided to reject a 1 billion euros ($1.4 billion) bid from Time Warner, according to a person familiar with the situation. Endemol officials declined to comment. A Time Warner spokesman also declined comment, but a source said the entertainment conglomerate has not been informed of any final decision about its bid. According to sources, Endemol, the company behind such international TV hits as Big Brother and Deal or No Deal, had told Time Warner that the firm would present creditors with a debt restructuring deal before considering any bid. Endemol and some of its lenders thought Time Warner's offer was opportunistic and too low. Endemol and its creditors, which include private equity players Apollo Management, Centerbridge and Providence Equity Partners, as well as such banks as Barclays and Goldman Sachs, seem ready to instead focus on finalizing a so-called debt-for-equity swap instead of doing a deal. The swap would convert debt into equity holdings in the company. Such a deal, likely to be completed by mid-December, could cut the company's debt and give it another chance to go it alone. According to Italian media reports, Silvio Berlusconi's Mediaset and Italian equity fund Clessidra want to inject more money into Endemol and in the process raise their current 33 percent holding to 51 percent. When TW's $1.4 billion bid became public earlier this month, sources said that TW saw debt-ridden Endemol as an opportunity to add a popular international TV content creator to its existing studio operations. Company executives saw Endemol similar to MGM a few years ago when the studio also explored its options amid challenges, meaning TW was prepared for a potentially drawn-out affair. While Moonves returns to the HRTS Thursday still at CBS' helm, News Corp. sold MySpace at the fire-sale price of $35 million -- about 6% of its acquisition cost -- and Couric is preparing to launch a daytime talkshow, what she ought to have done from the beginning.Still, those examples hardly lack for company, at a moment when it's easy to feel like we're living out the Firesign Theatre album (remember those?) titled "Everything You Know Is Wrong."The inability to see around fast-approaching corners obviously isn't confined to media. After all, few political pundits foresaw a first-term senator becoming America's first minority president in 2008. Moreover, thanks to the Web and cable news, the digital age offers more people making predictions than ever, only with less likelihood of getting anything right -- and almost no penalty for being dead wrong.Nevertheless, the breakneck pace of change complicates everything in media, from simple contracts to labor negotiations, precisely because looking ahead more than a few years is tantamount to flying blind.Perhaps that's why some view the current landscape as exciting and others plain gut-churning. It boils down to one's comfort relying on research, meticulous planning and rigorous analysis versus "Hey, your educated guess is as good as mine."Just six years ago, Lachlan Murdoch was the designated "first among equals" in the familial competition to eventually succeed his dad running News Corp. Then he left the company and brother James took the pole position. Now, with the phone-hacking scandal continuing to plague the media titan, it's increasingly unlikely anyone named Murdoch will be the next CEO.Far more recently most people would have correctly assessed Oprah Winfrey's bond with her audience as the most formidable relationship between a particular talent and viewers out there. The convulsions of Winfrey's joint venture with Discovery, OWN, have tempered those assumptions and reminded us that the margin for error in what might be called "broccoli TV" is razor thin.As recently as 2007, nobody would have given AMC -- American Movie Classics? The channel that always seemed to be airing "Road House"? -- a second thought on Emmy night. Now, it's become the home of some of TV's most prestigious dramas, including four-peat winner "Mad Men," reflecting just how quickly fortunes can turn.A lot of those programs wind up in someone's DVR queue, by the way, since about 40% of U.S. homes have them, compared to under 10% in 2006. As a consequence, the notion of zapping commercials has become so commonplace that the first glimpse of national ratings offer a highly incomplete picture, with aggregated tune-in for many top shows rising 40% or more over the next week.Then there's Netflix, which looked a whole lot smarter and in tune with its customers mere months ago than it does since its public meltdown.Conventional wisdom certainly isn't what it used to be.Granted, people switch jobs and companies suffer reversals all the time, but the sweeping forces reshaping the industry have arguably eclipsed the pace of change in previous decades by a country mile.If you're hungry for prognostication, by the way, don't bother soliciting it from Moonves. The Good Wife's Alan Cumming: "Eli Is Setting Himself Up For a Fall"

"In this episode, we find out that there is something very shocking that happened when Eli was married," Alan Cumming tells TVGuide.com. "So you see Eli very, very vulnerable for the first time ever." Why? The arrival of Eli's ex-wife, Vanessa, played by Parker Posey, has a lot to do with it. It's no coincidence that the two actors have shared the screen several times before (most memorably in The Anniversary Party and Josie and the Pussycats) and Cumming immediately suggested Posey for the part. "I think Parker is the funniest person ever. I could just watch her walking on the street and think its fascinating. Everything she does, she brings such an idiosyncratic energy to It," he says. "She's hilarious in this. And there are also some really touching scenes in there." So it's been really fun to increase my acting partners," he says. "Also, it's nice to have a base and to know that when I do scenes in my office, that's my office. I had, like, five different offices in different locations last year so I feel much more focused." As evidenced by his recent push to snag Peter (Chris Noth) the keynote speech at the Democratic National Convention, Eli is determined to put Peter in the governor's mansion. "Next summer is when that keynote speech is going to take place, so I imagine the beginning of next year will see Eli back on the political path with Peter," he says. The only thing standing in the way of that path is Alicia (Julianna Margulies). Eli promised a prominent politician that the Florricks would be together come convention time, so the question is what measures he will go to in order to bring the fragmented family back together. And will the man so used to winning big even be successful? "I have no doubt that Eli is setting himself up for a fall because he's so determined to make Peter into this great political phenomenon, and he needs Alicia to help him do that. He's kind of in denial about that fact," Cumming says. "I think that he's staked so much of his own reputation on that so I think he'll go as far as he can. That might mean manipulating Alicia to get what he wants. You never know, maybe Alicia and Peter will get back together." "There's definitely a course to make that happen by whatever means." NYFF event for new filmmakers
Film Society of Lincoln Center and IFP have teamed to launch the Emerging Visions program, an initiative for up-and-coming creatives to run during the NY Film Festival. A roster of 25 filmmakers selected for the program will meet with established helmers and producers including Shari Springer Berman, Barbara Kopple. Philip Seymour Hoffman and Doug Liman, as well as participate in a pitching session with indie types such as Christine Vachon and John Sloss. Organizers of the program hope the sessions will help the launch the up-and-comers' careers. List of emerging filmmakers tapped for the program includes Alrick Brown ("Kinyarwanda"), Adam Bowers ("New Low") and Lanre Olabisi ("August the First"), among others. Hannibal Lecter Heading To TV
Okey-dokey. Here we go.... There was a time when Hannibal Lecter was a properly chilling less-is-more villain with minimal screentime and maximum impact. Gradually though, he's become everyone's favourite mischievous uncle, and we'll get to spend even more time with him when Gaumont's Hannibal series arrives on TV. Hannibal is an inaugural project for the new LA-based outpost of the French film studio, and will be executive produced by Pushing Daisies creator Bryan Fuller, and Martha De Laurentiis, who was behind the most recent three Lecter films, Hannibal, Red Dragon and Hannibal Rising. It's unclear whether original author Thomas Harris is involved. The premise revolves around the back story discussed in Red Dragon (film and book) and Manhunter: the early relationship between psychiatrist Lecter and FBI profiler Will Graham, who can see inside the heads of serial killers. Quite how this will play out week-by-week remains to be seen. Are we looking at one story per season? Or individual stories about Lecter killing sprees and Graham on his trail? Or individual stories about Graham on cases, visiting Lecter for advice occasionally? Or a mismatched buddies double act, where Howlin' Mad Hannibal must be regularly sprung from the Baltimore State Hospital for another crazy adventure?Whatever, there are no showrunners or writers attached so far, and no cast yet chosen to fill the shoes previously inhabited by Anthony Hopkins, Brian Cox, William Peterson and Edward Norton. Although the bearded Tori Spelling stalker is indeed in charge of making the nominations, the person really running the game is the winner of tonight's power of veto competition. So, who won? And which players are now in the final three? Let's find out.Even Adam seems to believe he's the one holding all the cards this week. "I have three beautiful women working for me," he says. And while he did finally win HOH and earned a basket of bacon-themed junk, he still hasn't necessarily proven himself to be a good player.Take, for example, his exchange with Jordan. Once she suspects that Adam may be thinking of taking Porsche to the final three (and likely final two), Jordan can't help but tell Adam how "fuss-trated" she is with him. And rather than defend himself, or make any kind of argument, really, he just sits and giggles and makes things worse for himself.In truth, he kind of did confess to Porsche that having two newbies in the finals would be nice. And while I agree it would be more fun not to see a repeat player on finale night, Adam would have an incredibly hard time beating both Rachel and Porsche in the final HOH. Jordan? Not so much. However, Adam is smart enough to know that if he wants to possibly take out Rachel, his best bet is to not nominate her, which perhaps will keep her from playing as hard in the veto as she would if she were on the block.And indeed, Adam smartly puts up Porsche and Jordan for eviction. He says he wants both girls to know what it feels like to fight hard and earn your safety, just like he did earlier this week. The veto competition requires players to answer questions by stacking blocks with evicted houseguests' names on them in the appropriate order.Porsche smartly stacks the blocks on the ground before moving them into position, as removing them one at a time if she's wrong is extra time consuming. Adam thinks he's nailing the whole thing, Rachel is running around like a crazy person and Jordan....well, she looks confused as ever. Ultimately, Porsche completes the puzzle first and wins the most important veto of the summer.And, here comes Rachel's tears. She bawls about how she can't do anything right and that she wanted to win for Brendon. "This game is so hard," she says. She mopes and whines until Jordan tells he how great she is and how she deserves to stay over Jordan. It honestly seems as if Jordan is already convinced she's going home. Rachel finally gets herself together and makes a pitch to Porsche. Rachel says she voted for Porsche over Kalia and says Porsche has a better chance of winning in the final two over Rachel than Jordan. (I personally think that's not true.) Anyway, Porsche seems to like Rachel's rationale.So, when it comes time for the veto ceremony, Porsche (shocker!) uses the veto to save herself. Rachel and Jordan's final pleas are all rainbows and hugs and kisses to everyone left in the game. But even though everyone loves everyone else so much, Porsche gives Jordan the boot. (At least Jordan got one good line in before she left: Commenting on how little she knows Porsche, Jordan said "I know you like to wear bikinis and host competitions.")In her goodbye message to Jordan, Porsche claims that she couldn't risk Jordan not taking her to the final two. (She assumes, perhaps correctly, that Jordan would have chosen Adam over her.) Here's what I think both Porsche and Adam fail to realize: Rachel is a beast at competitions when her life is on the line. I think she will almost certainly win the endurance leg of the final HOH competition; in my mind she will win the whole thing. I think Rachel will beat either person she brings to the finals simply because the jury house is going to reward a competitor over a floater. Conversely, who in the jury would give Jordan the money twice? I think Porsche made a $500,000 mistake.But we shall see! The episode ends with the final three spinning on a Big Brother mixer. Whoever hangs on the longest while being pelted with goo and dipped into butter will win an automatic bye to the third part of the competition. Tahrir Square doc takes spaghetti Western route
The spring Egyptian revolt in Cairo's Tahrir Square has prompted a deluge of docus. But "Tahrir 2011 -- The Good, the Bad, and the Politician" is likely to be the only one loosely inspired by a spaghetti Western."I wanted to do the same event from different perspectives, so Sergio Leone's 'The Good, the Bad and the Ugly' came to mind," said Amr Salama, one of three helmers of the sometimes playful docu structured in three half-hour chapters."It gives you the whole perspective. It's a like a three-dimensional film, in a way," said Salama, who handled "The Politician" section, which delves into the psyche of toppled dictator Hosni Mubarak.Salama's section is a satirical take on "how to become a dictator in 10 steps," he said, "as if it were a bad infomercial; and the 10th step is the denial and how a dictator falls."He said he sourced it from people who spent time with Mubarak in his final days in power, "especially the guy who spent the last 48 hours with him before he stepped down." It's "almost a mockumentary, with a surreal, satirical approach." That is "because when I was making it I was so stressed, that I could not take it seriously." For Ayten Amin, who shot "The Bad" section dedicated to the country's police and security forces, the film is first and foremost "a personal journey.""Before the revolution I never did anything political, and I never talked to a police officer," she said.Not surprisingly, most the police officers she interviewed did not want to talk to her, at least not at first."All the interviews went on for five or six hours; but the last 30 minutes were the most important because they just got tired of lying," she said.In a way, Tamer Ezzat, who handled "The Good," about the ordinary heroes in Tahrir Square, may have had the easiest task. "For me it was obvious. I really identified with who the good people were and who the bad people were," he said.But he had to sift through a massive amount of material. "Our editor has established a media center in the middle of Tahrir Square where we received donated footage shot on cellphones and video cameras. We used that as our starting point." For all of them it's important that this film was partly made by the people who were active in the revolution. They also used Twitter and Facebook to ask folks to provide them with footage. And they got more than 300 gigabytes' worth."The people gave us their material because they appreciated the power of documenting this revolution for future generations," Samara said.Docu, being sold by Pacha Pictures, segues to Toronto and a slew of other fests. Broadway Takes 36% Hit in Weekly Box Office Amid Hurricane Irene Show Cancellations
NEW YORK - Broadway took a major box office hit with the gross for the week ended Sunday down 36 percent amid show cancellations due to Hurricane Irene,according to the latest data from The Broadway League. The box office for the week ended Sunday amounted to $11.62 million, down from $18.15 million during the same week of last season, according to the BroadwayLeague. Attendance for what was the 13th week of the season fell from 204,265 to 130,853, while average paid admission stayed about the same. All 66 performances scheduled for Saturday and Sunday were cancelled "as a result of suspension of public transportation, evacuations of many areas,closures of some highways and potential bridge closures by government authorities in preparation for Hurricane Irene," the Broadway League highlighted. Some shows though continued to do brisk business despite Irene. The Book of Mormon, for example, grossed $786,459, or 106 percent of its weeklypotential gross calculated based on potential attendance, according to the League's data. Still, the show slipped $487,785 from the previous week. Billy Elliot: The Musical had only four performances last week, grossing $358,485, down from $731,895 in the prior week when it had twice as many shows. Season-to-date, the Broadway box office stands at $268.4 million, up 1.1 percent compared with $265.5 million in the year-ago period. Attendance is down 0.9 percent at 2.97 million. Telemundo Stations to Expand Local News Programming by 25%
our editor recommendsMore original content for Telemundo NEW YORK - NBCUniversal's Telemundo said Monday that its TV station group will increase local news and public affairs programming by more than 25 percent by January. As part of the move, the Spanish-language media company will launch local weekend news program in New York and local public affairs programs in LA and New York, the nation's largest media markets, among other things. Overall, it will add more than 1,000 hours of news and public affairs offerings. Comcast promised regulators when it acquired NBCUniversal that it would expand news and public affairs content on local stations. Management reiterated during a quarterly earnings call last week that Telemundo and boosting local TV news are key growth opportunities. The Telemundo Station Group on Monday announced the launch of morning news shows in LA and Houston; local weekend news programs in New York, Dallas and Puerto Rico; weekday news programs in Denver; and local public affairs programs in Los Angeles, New York, Miami, Houston, Chicago, Dallas, Phoenix and Puerto Rico. They will all be launched by the end of Jan. 2012. The group also said it is making a multi-million dollar investment in upgrading local technical infrastructure at its top Hispanic market stations to give them local HD news production capability. "This expansion of local news and public affairs programming at the Telemundo owned stations reinforces our commitment to the communities we serve," said Ronald Gordon, president, Telemundo Station Group. "A focus on local service has been an ongoing priority at Telemundo, and we have made significant investments to enhance our local news programming, resulting in substantial ratings growth in our markets." As part of the news push, the hour-long weekday program Buenos Dias Los Angeles, returned to KVEA in the 6am slot as of June 13. Among other changes, starting in September, Telemundo will launch new public affairs programs, which will be locally produced, in eight markets. "These programs will help audiences understand the key role played by Latinos in our country and, as the 2012 election season approaches, will underscore the importance of Latino participation in our nation's political process," the company said. Yes, thats right, Roseanne Barr has announced shes running for President of the United States. Jay, I decided since youre the one who got Arnold Schwarzenegger elected as governor of California that I wanted to make my announcement here, on your show, because I really want to ask for your support, Roseanne told Jay Leno during an appearance on Thursdays The Tonight Show. My announcement is that I am running for President of the United States. The 58year-old former small screen star said she wants to join the 2012 race so that she can be part of the debates and represent the taxpayers. In fact, Im choosing the taxpayers as my Vice President, she told Jay, to rousing cheers from the audience. I want to put the questions to the panel about like, where the hell did our money go? Thats number one. In addition to an immediate accounting for the government bailout money, Roseanne declared she has another type of green on her mind. The legalization of marijuana is number one the end of all drug wars, she told the late night host of her top priorities. Roseanne, who moved to Hawaii in 2007 to farm Macadamia nuts a move which is chronicled on her Lifetime reality show, Roseannes Nuts said shes been inspired by former Alaska Governor and Vice Presidential candidate Sarah Palin in both her foray in reality television and a bid for Presidency. Its because of [Sarah Palin] that I decided to do a reality show. And also, I have feral pigs that overrun my farm and Id like to shoot them out of a helicopter, she told Jay with a smile. Thats kinda what got me to thinking that I too should run for President if she can. As for her potential party affiliations, Roseanne has no interest in being associated with either Democrats or Republicans. Im not for either party because they both suck and theyre both a bunch of criminals, she said. I made up my own party its Americas Green Tea Party. Thered be no taxes.
